بیانیه مشترک جامعه مدنی برای آزادی پنج زندانی سیاسی اعتصاب کننده آذربایجانی درایران

پنج زندانی سیاسی آذربایجان کە هر کدام به ٩ سال زندان محکوم شده اند، اکنون چهارهفته است دراعتصاب غذا بسر می برند و روزبروز وضعیت عمومی آنها رو به وخامت می گذارد. 

احکام زندانیان آذربایجانی بروشنی منافی قوانین بین الملل و البته ناقض اصل ٢٦ قانون اساسی جمهوری اسلامی ایران میباشد.

لطیف حسنی، آیت مهرعلی بیگلو، محمود فضلی، شهرام رادمهر و بهبود قلیزاده کادر رهبری تشکیلات یئنی گاموح هستند که از روز بیست و دوم تیرماه/ سیزده جولای ٢٠١٣  در اعتراض به روند ناعادلانه دادرسی وهمچنین شرایط بد زندان تبریز دست به اعتصاب غذای نامحدود زده اند.

٩ اردیبهشت ماه ٩٢ (٢٩ آوریل ٢٠١٣) شعبه سوم دادگاه انقلاب تبریز به ریاست قاضی باقرپور برای هرکدام ازاین فعالین حکم سنگین ٩ سال حبس تعزیری – جمعاً ٤٥ سال حبس – را صادر کرد. اتهامات وارده تبلیغ علیه نظام وتشکیل گروه غیرقانونی عنوان شده است. در ٢٣ خردادماه ٩٢ ( ٩ ژوئن ٢٠١٣ ) درشعبه ششم دادگاه تجدید نظرتبریزبه ریاست قاضی ایمانی، این حکم را تائید شد.  ازفعالیتهای گروه “یئنی گاموح” ارسال نامه سرگشاده به دبیرکل یونسکو در رابطه با محرومیت کودکان آذربایجانی ازحق تحصیل به زبان مادری – کە طبق اصل ١٥ قانون اساسی جمهوری اسلامی ایران، تدریس آن آزاد می باشد – بوده است که از طرف دادگاه به عنوان تبلیغ علیه نظام قلمداد شده است. 

امروزبیست و ششمین روز اعتصاب پنج زندانی سیاسی آذربایجانی در ایران است. هر پنج فعال درپی اعتصاب غذا از زندان تبریز به تهران تبعید شده اند و روز چهارشنبه بعد از یکروز حبس در انفرادی زندان اوین به قرنطینه زندان رجایی شهر کرج انتقال یافته اند. این زندانیان در تماس کوتاه تلفنی از آخرین وضعیت جسمانی خود گفته ونحوه انتقال به تهران و شرایط خود از دو روز بی خبری حاکم،  پرداختند. دومان رادمهر، برادر شهرام رادمهر در اینباره می گوید: “اعتصاب کنندگان یئنی گاموح در انتقال به تهران شکنجه شده اند. زندان اوین به خاطر و ضعیت جسمانی بی حال آنها، از قبول مسئولیت جان آنها امتناع کرده بود و آنها به مدت یکروز و نیم با دستبند و پابند در اتاقک فلزی داخل ماشین انتقالی که صندلی هم نداشته، درگرمای تهران در حیاط زندان اوین بر روی کف فلزی ماشین ون سپری کرده اند. وضع عمومی این زندانیان روزبروز روبە وخامت می رود و امروز در قرنطینه زندان رجایی شهر هم مهندس محمود فضلی خونریزی معده داشته است. وضعیت جسمانی آنها، به گونه ایست که برخی از آنها با ملاحظه نگرانی خانواده هایشان ازگفتن وضعیت دقیق خود خودداری میکنند”.

البته این تنها نمونه ای از بیعدالتی درقبال فعالین مدنی آذربایجانیست. روزانه دهها مورد از این قبیل موارد نقض حقوق بشر در آذربایجان اتفاق میافتد. از جمله آنها سعید متین پور روزنامه نگار آذربایجانی است که به هشت سال حبس محکوم شده و تا بحال بعد از چهار سال حبس اجازه مرخصی به وی داده نشده است.  مهدی حمیدی شفیق به خاطر فعالیت برای نجات دریاچه اورمیه به دوسال زندان محکوم شده و هم اکنون هم به خاطر خبر رسانی وضعیت اعتصاب کنندگان از زندان تبریز دوباره به ادراه اطلاعات تبریز منتقل شده است.  شاهرخ زمانی و هوتن جاوید کیا به ترتیب فعال کارگری و وکیل آذربایجانی هستند که به حبس های طولانی مدت محکوم شده اند و یونس آقایان که به خاطر دفاع از حقوق اقلیت مذهبی “اهل حق” به اعدام محکوم شده است و هزاران مورد دیگر ….

ما امضا کنندگان زیر ضمن درخواست آزادی فوری این زندانیان، توجە همگان را بە وضعیت اسفبار نقض حقوق گروەهای اتنیکی واقلیتهای مذهبی- دینی کە همراە و همزمان با سرکوب شدید و تبعیض های سیاسی، اقتصادی، فرهنگی واجتماعی از کمترین پوشش خبری برخوردار است، جلب کردە و از جامعە جهانی درخواست واکنش نسبت بە این مسالە را داریم. از پنج فعال آذربایجانی درخواست داریم بنام آرمان هاي مقدس وانساني كه ما را در كنار بخش بزرگي از جهان در جبهه عدالت ودمكراسي قرار مي دهد٬ به اعتصاب غذای خود پایان دهند.

 

Civil Societies Declaration on Five Azerbaijani Hunger Strikers in Iran

Five Azerbaijani prisoners of conscience, being sentenced for 9 years of imprisonment for each, are continuing hunger strike for 4^th week and their health condition have turned into critical situation. The court upholds harsh sentences against these Azerbaijani activists. This violent sentence which originates from racist view is in contrary to human rights norms also it is against the section 26 of constitution of Islamic Republic of Iran.

LatifHassani, Mahmoud Fazli , ShahramRadmehr , AyatMehr Ali Bayglu  and BehboudGholiZade  the Yeni GAMOH party leaders started unlimited hunger strike on July 13, 2013 in Tabriz Center Prison protesting their unfair trial and mistreatment. 

Mr. Bagherpour, the judge of third branch of Tabriz revolutionary Court, sentenced the mentioned political activists for nine years imprisonment on the charge of establishing illegal group and of distributing anti-government propaganda. However, the court of appeal approved the sentence on June 9 2013. One of the activities of Yeni GAMOH group is sending an open letter to UN Secretary General concerning the right of Azerbaijani children to educate in their native language that according to article 15 of the Iranian constitution it`s free to educate. However the court is regarded this as an anti-government propaganda. 

Twenty six days passed from hunger strike. During this period, Tabriz Prosecutor’s Office and main Prosecuting Officer, Mr. Khalilolallahi exiled them from Tabriz to Tehran on the eighth day of hunger strike .However, the executives of Evin Prison in Tehran refused to admit them because of their severe conditions, and finally after one day solitary confinement in Evin Prison in Tehran, they were moved to RajaeShahr Prison in Karaj city. They were tortured several hours during transporting from Tabriz to Tehran in the hot summer weather condition while according their relatives’ reports, they have already been suffering from serious illness because of being tortured during interrogations.

Duman Radmehr, brother of Shahram Radmehr says “strikers have been tortured in their transfer to Tehran. Evin prison in Tehran had denied accepting responsibility of their lives because of their critical health condition. The strikers spent a day and a half in handcuffs and shackles inside a metal room of a van under the direct sun heat of Tehran.The general situation of these prisoners is worsening day by day, and today Mahmoud Fazli had stomach bleeding in quarantine of RajaeShahr prison.Their physical condition is in such a crucial condition so that some of them refuse to say their exact feeling considering concerns of their families”

Of course this is just an example of injustice behaviors against Azerbaijani activists. Dozens of such human rights violations taking place in Azerbaijan in a daily based. Among them; Saeed Matinpour, Azerbaijani journalist has been sentenced to eight years of prison, and after four years in prison, he has been deprived of furlough. As another example, Mehdi Hamidi Shafigh was sentenced to two years in prison because of participating in a meeting for saving Urmia Lake. Also, he has been moved from Tabriz Prison to intelligence (Ettelaat) cell as a punishment because of his efforts to report the news of the strikers’circumstances. 

In addition, Shahrokh Zamani and Houtan Javidkia, labor activist and Azerbaijani lawyer respectively, have been sentenced to long imprisonment, alsoYounesAghaianhas been sentenced to death because ofhis activities towards protection of religious rights of “Ahl-e Hagh” minority group, and each year hundreds of them receive unfair trial and are subject to arbitrary detention. 

We, the undersigned, demand the immediate release of these prisoners. We draw the attention of everybody to the plight of the violation and human right abuse against ethnic groups and religious minorities. All protests against wide variety aspect of discrimination; political, economic, social, and cultural rights are repressed brutally. We demand the international community to respond to this issue, also we ask the strikers to end their hunger strike on behalf of the great and holly ideas that puts us with a sufficient number of the world people on justice and democracy side.
