كونگره‌ی نه‌ته‌وه‌یه‌كگرتووه‌كان له‌م خوله‌ی كۆبوونه‌وه‌كانی تیشك ده‌خاته‌ سه‌ر پرسی كه‌مایه‌تیه‌كان له‌ سیستمی دادوه‌ری جینایی (كه‌یفه‌ری) دا.

 

ته‌یمووری ئه‌لیاسی نوێنه‌ری كۆمه‌ڵه‌ی مافی مرۆڤی كوردستان، له‌ وتارێك دا، سرنجی نه‌ته‌وه‌یه‌كگرتووه‌كانی بۆ لای پرسی كورد و نه‌ته‌وه‌كانی ئێران له‌ سیسته‌می نادادپه‌روه‌ری جینایی (كه‌یفه‌ری) كۆماری ئێسلامی ئێران دا ڕاكێشا.

 

ده‌قی وتاره‌كه‌ له‌ ئینگلیسی یه‌وه‌ وه‌رگێڕاوه‌:

 

خاتوو سه‌رۆك،

كۆمه‌ڵه‌ی مافی مرۆڤی كوردستانی ئێران – ژنێڤ سرنجتان بۆلای پرسی گه‌لی كورد له‌ چوارچێوه‌ی سیستمی دادپه‌روه‌ری جینایی كۆماری ئیسلامی ئێران ڕاده‌كێشێ.

به‌ پێی ماده‌ی ٤ ده‌ستووری كۆماری ئیسلامی ئێران ده‌بێ : ` هه‌موو یاساكانی مه‌ده‌نی، جینایی (كه‌یفه‌ری)، ئابووری، ئیداری، كولتوری، سیاسی و هتد له‌ سه‌ر په‌ره‌نسیپی شه‌ریعه‌تی ئیسلام واته‌ مه‌زهه‌بی شیعه‌ی دوانزه‌ ئیمامه‌` دانرێت. هه‌روه‌ها ماده‌ی ١٥ هه‌مان ده‌ستوور زمانی فه‌رمی وڵات فارسی دیاری ده‌كات.

ئه‌م مادانه‌ و سه‌دان ماده‌ی ناڕوون و پێچه‌وانی ده‌ستووری كۆماری ئیسلامی وه‌ك ` موحارب` له‌ یاسای جینایی ئێران دا، په‌یمانه‌ نێونه‌ته‌وه‌یه‌كانی پێوه‌ندیدار به‌ كه‌مایه‌تیه‌كان ژێر پێ و پێشێل ده‌كه‌ن، جێگه‌ی وه‌بیرهێنانه‌وه‌یه‌ كه‌ ئێران به‌شێكه‌ له‌و په‌یماننامانه‌.

 

سیسته‌می دادوه‌ری ئێران زۆردووره‌ له‌ هه‌موو ستاندارد و یاسا نێونه‌ته‌وه‌یه‌كان. حوكمی دادگا له‌وانه‌ سزای له‌ سێداره‌دان به‌ بێ له‌ به‌رچاوگرتنی چوارچێوه‌ و عورفی دادگا و په‌یمانه‌ نێونه‌ته‌وه‌یه‌كان جێبه‌جێ ده‌كرێت. بۆ وێنه‌، زیندانیان له‌ كاتی گرتنیان ده‌ستڕه‌سیان به‌ وه‌كیلی هه‌ڵبژارده‌ی خۆیان نیه‌. به‌ شێوه‌یه‌كی ڕووتین، زیندایان له‌ ژێر ئه‌شكه‌نجه‌ و بێحورمه‌تی و فشاردا ئیعترافیان پێده‌كرێت و دادگاكان به‌ پشت به‌ستن به‌و ئیعترافانه‌ی كه‌ له‌ ژێر ئه‌شكه‌نجه‌ وه‌ده‌ست هێنراون، زیندانیان مه‌حكووم ده‌كه‌ن كه‌ ئه‌وه‌ش پێچه‌وانه‌ی په‌یمانه‌ نێونه‌ته‌وه‌یه‌كانه‌.

 

زۆرینه‌ی ئیعدامه‌كان له‌ ئێران له‌ پێوه‌ندی له‌ گه‌ڵ ماده‌بێهۆشكه‌ره‌كان جێبه‌جێ ده‌كرێن. به‌ پێی په‌یمانه‌ نێونه‌ته‌وه‌یه‌كان، سزای له‌ سێداره‌دان بۆ ماده‌بێهۆشكه‌ره‌كان پێچه‌وانه‌ی یاسای نێونه‌ته‌وه‌ییه‌. یاسای سزایی (كه‌یفه‌ری) ئێران حوكمی له‌ سێداره‌دان بۆ په‌یوه‌ندی جنسی بۆ دوو كه‌سی ڕازی (بالغ) و جینایه‌تی ئابووری له‌ به‌رچاو ده‌گرێت كه‌ نابێت بخرێته‌ چوارچێوه‌ی یاسای جینایی (كه‌یفه‌ری) وه‌.

 

سزای له‌ سێداره‌دان له‌ سه‌ر بنه‌مای هه‌ڕه‌شه‌ له‌ سه‌ر ئه‌منیه‌تی میلی و جینایه‌تی خه‌یاڵی ` دژایه‌تی كردنی خودا` یا موحارب له‌ دژی نه‌ته‌وه‌كانی كورد، به‌لووچ، عه‌ره‌بی ئه‌هواز، توركی ئازه‌ربایجانی و توركمه‌ن به‌ شێوه‌یه‌كی له‌ ڕاده‌به‌ده‌ر كه‌ڵكی لێوه‌رده‌گیردرێت له‌ لایه‌ن ڕژیمه‌وه‌. نه‌ته‌وه‌كانی ژێر سته‌می ئێران به‌ شێوه‌یه‌كی به‌رفراوان قوربانی سیاسه‌تی ته‌بعیزی كۆماری ئیسلامین له‌ یاسا و به‌ كرده‌وه‌ و له‌ مافه‌ ئابووری، كۆمه‌ڵایه‌تی و كولتوریه‌كانیان بێبه‌شن.

 

ڕوون و ئاشكرایه‌ كه‌ سیاسه‌تی جیاوازی دانان و هه‌ڵاواردنی كۆماری ئیسلامی دژی گه‌لی كورد و نه‌ته‌وه‌كانی ئێران، بێ هه‌ڵویست و فشاری كۆمه‌ڵه‌ی نێونه‌ته‌ویی كۆتایی نایه‌ت. به‌هیواین كه‌ خاتوو ` ڕیتا ئیتزاك` ڕاپۆرتێری تایبه‌تی نه‌ته‌وه‌یه‌كگرتووه‌كن بۆ كه‌مایه‌تیه‌كان، له‌ ڕاپۆرته‌كانی و ڕاگه‌یاندراوه‌كانی و هه‌روه‌ها كۆماری ئیسلامی ئێڕان ده‌بێت ڕێگای سه‌فه‌رێكی بۆ ئێران پێبدات بۆ ئه‌وه‌ی ڕاپۆرتێك له‌ سه‌ر گه‌لی كورد پێشكه‌ش بكات كه‌ ڕووبه‌ڕووی سیاسه‌تی ژینۆسایدی كۆماری ئیسلامی ئێرانن.

The KMMK-G’s oral statement to the eighth session of the Forum on Minority Issues on “Minorities in the Criminal Justice System”

Thank you Madam the President,

The Association for Human Rights in Kurdistan of Iran-Geneva would like to draw your attention on the situation of Kurdish people in the Iranian Criminal Justice System.

According to Article 4 of the Iranian Consitution : “All civil, penal, financial, economic, administrative, cultural, military, political and other laws and regulations must be based on Islamic principles of Sharia the Shia faith ⁴…” and article 15 of the same constitution stipulates that the official language of the state is Persian.

Iran’s international obligations in regards to minorities.

Trials in Iran often fall far short of international law and standards. Sentences, including the death penalty, are often imposed without any regard to internationally prescribed safeguards, such as access to a lawyer of one’s choice from the time of arrest. The use of “confessions” coerced under torture or other ill-treatment is routinely reported, and courts generally rely on evidence obtained in breach of international law and standards.

The vast majority of executions in Iran are for crimes such as drug-related offenses where international law clearly prohibits the death penalty, as the offenses are not ‘the most serious crimes’. Iranian law maintains the death penalty for financial crimes and for acts that should not be considered criminal at all including consensual sexual relations between adults.

Executions based on national-security-related charges and imaginary crimes of enmity against God are often politically motivated and it’s carried out disproportionately against members of Iran’s ethnic nationalities such as Kurds, Baluchis, Ahwazi Arabs, Azerbaijani Turks and Turkmen who experience widespread discrimination in law and practice, including in the enjoyment of their economic, social and cultural rights.

It is clear that discriminations against the Kurds and other minorities will not be improved without consideration of the international community. We hope that Special Rapporteur Ms. Rita IZSÁK, in her reports and in periodic statements, will be allowed to visit Iran and provide a report on Kurdish people who is facing genocidal policies.
